hoastnow General Terms of Service

1. Acceptance
By accessing or using hoastnow.com, the hoastnow app, or any services (collectively the "Platform"), you agree to these General Terms and, if you book or list spaces, the applicable Brand Terms or Community Terms.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.
4. Prohibited Conduct
You may not:
- violate any law or regulation
- infringe intellectual property rights
- transmit viruses, malware, or harmful code
- scrape, spider, or automate access to the Platform
- interfere with or disrupt the Platform
- impersonate any person or entity
- use the Platform for unsolicited commercial messages (spam)
5. Intellectual Property
The Platform and its content (logos, design, software) are owned by Kuhl Group LLC dba hoastnow or its licensors. You are granted a limited, non-transferable license to use the Platform for its intended purpose only.
6. Disclaimers
The Platform is provided "as-is" without warranties of any kind. hoastnow does not screen or endorse Brands or Properties and makes no representations about safety, suitability, or legality of any listing or event.
7. Limitation of Liability
To the maximum extent permitted by law, hoastnow, its officers, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Total liability shall not exceed the fees paid by you to hoastnow in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless hoastnow from any claims, losses, or damages (including attorney fees) arising from your violation of these Terms or your use of the Platform.
9. Termination
We may suspend or terminate your access at any time for any reason without notice.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
11. Changes
We may update these Terms at any time. Continued use after changes constitutes acceptance of the new terms.
